General terms and conditions

1. Subject
The present terms of sale define the contractual relationship between FAZO and the buyer, and conditions applied to all purchases made through the merchant site of FAZO, the buyer being either professional or consumer.
The acquisition of a good or service through this site implies unreserved acceptance by the purchaser of the present terms of sale.
These conditions shall prevail over any other general or special conditions not specifically approved by FAZO.
FAZO reserves the right to modify these terms and conditions at any time. In this case, the applicable conditions will be those in force at the date of the order by the purchaser.

2. Characteristics of goods and services proposed
The products and services offered are those listed in the catalog published on the site FAZO (www.fazocosmetic.com).
These products are offered within the limits of available stocks.
Each product is accompanied by a description provided by FAZO.
The photographs in the catalog are as accurate as possible but cannot ensure a perfect similarity with the product, especially with regard to color.

3. Prices
The prices listed in the catalog are included VAT, expressed in Euro, taking into account the VAT applicable on the day of the order; any rate change will be reflected in the price of goods or services.
FAZO reserves the right to modify its prices at any time, except that the prices listed in the catalog on the day of the order shall be the sole applied to the buyer.
The indicated prices do not include delivery charges (shipping).

4. Shipping costs
Shipping costs are charged depending on the country of destination.
For Belgium
Our packages are sent by post - Shipping costs 7,20 Euro
For all orders equal to or exceeding 60,00 Euro, the shipping costs are free, for shipments to Belgium only.

5. Order

The buyer who wishes to buy a product or service via internet must:
- Complete the order form online by selecting all the references of selected products
- Fill in the information sheet which show all the data requested;
- Choose the method of payment (PayPal, credit card, bank transfer)
- Validate the order after having checked it;
- Make payment under the conditions provided;
- Confirm the order

Confirmation of the order implies acceptance of these conditions of sale, in acknowledgment of having perfect knowledge and renunciation to prevail of its own conditions of purchase or other conditions.
All data recorded and confirmed valid proof of the transaction. Confirmation is worth signature and acceptance of transactions.
FAZO will email confirmation of the order recorded.

6. Withdrawal
The buyers, non-professional individuals, have a withdrawal period of fourteen calendar days as from receipt of their order to return the product to the seller for exchange or refund.
All returns must be reported prior to FAZO's customer service. The product must be returned to the address of FAZO.
FAZO will only accept products returned in their entirety, in their original packaging and undamaged, and in perfect resale condition. Any product that has been damaged or whose original packaging has been damaged, will not be refunded, returned or exchanged.
This right of withdrawal is without penalty, except for shipping and back.
In the case of exercise of the right of withdrawal, the buyer has the option of requesting either refund of the amounts paid or exchange of the product. In case of an exchange the return will be at buyer's expense.
In case of exercising the right of withdrawal, FAZO will reimburse the buyer within thirty days after receipt of the returned product.

7. Payment terms
The price is due with order.
The payments are made via the secure PayPal platform (Paypal, Visa, MasterCard, American Express), or by bank transfer.
The buyer's account will only be debited the amount of goods sent and, if applicable, of shipping costs.
On request of the buyer, a paper invoice showing VAT will be sent.

8. Delivery terms and times
Delivery of ordered items is done at the residence of the buyer or at any other address he indicated when ordering. Information given by the buyer when ordering commits him.
In case of error in the address of the recipient or incomplete information, FAZO cannot be held responsible for the impossibility in which it could be to deliver the product.
In case of return of goods for incomplete address, the buyer will be offered two alternatives:
- Reshipment of the goods after payment of contribution to the cost of return
- Reimbursement of the order after deduction of delivery charges

Orders are delivered in one time at one place.

In case of damage during delivery complaint must be transmitted to FAZO within three days from delivery.
The exchange of any product declared, a posteriori, damaged during transport, without any reservation issued on receipt of the package, cannot be supported.
The buyer must report any anomaly concerning the delivery (damage, missing product compared to delivery order, damaged package, broken product…) to the transporter (on the delivery slip as "handwritten reserves").
The buyer will confirm this problem to the transporter by addressing a registered mail stating the claims, within two working days from delivery date.

Deliveries in Belgium take place within 8 working days following receipt of the payment of buyer's order, excluding exceptional stock-outs and holiday periods.
Delivery times are indicative; if they exceed thirty days from the order the contract can be terminated and the buyer repaid.
The buyer, who has not received his package within the time specified, must report within the 2 weeks of the delivery deadline for his request to be considered.
As in any expedition it is possible to experience delays or that the product gets lost. Where appropriate we will contact the carrier to find this package. If necessary, FAZO will deliver a new identical package at his expense.
FAZO disclaims any responsibility with regard to extension of delivery times due to the carrier, especially in case of loss of goods, bad weather or strikes.

9. Guaranty
The buyer must make to FAZO, within three days of delivery, any claim of error of delivery and/or non-conformity of goods in kind or in quality compared to the indications appearing on the order form.
Beyond this period any claim will be rejected.
In case of non-compliance of product sold, it can be returned to FAZO that will exchange or refund it.
All claims, requests of exchange or refund must be made by post to the following address: FAZO, av. du Bois de la Cambre 197, B – 1050 Brussels, or by email to the following address: info@fazocosmetic.com 
Any claim not made in the above set rules and within the time limits can not be tak en into account and releases FAZO from any liability towards the purchaser.

10. Products guarantee
FAZO takes the utmost care in the selection, origin and production of the products it sells.
The products of the brand FAZO comply with the regulations and laws in force in the countries of the EC.
In all cases, FAZO can not be held responsible for non-compliance with regulations and laws in force in the country of reception outside the EC.
Each product has an expiry date that has to be respected.
In addition some products need storage away from heat and light.
FAZO can not be held liable for damages of any kind, whether material or immaterial, which may result from improper use of products sold.
The liability of FAZO will be limited to the amount of the order and shall not be questioned for simple errors or omissions that may occur despite all precautions taken in the presentation of products.

11. Responsibility
The seller, in the process of online selling, is only bound by an obligation of means; its responsibility can not be held liable for damages resulting from the use of the internet such as data loss, hacking, viruses, break service, or other unintended problems.

12. Your personal data
In order to process orders, contact details of the buyer are required (name and address for delivery and invoicing, email address and phone number).
FAZO does not release at any time these details to third parties.
At any time the buyer has a right to access, modify, rectify and delete data concerning him, that he can exercise to FAZO:

13. Intellectual property
FAZO has the full rights of intellectual and industrial property (copyright, designs and models, trade mark, software, database…) related to all elements of the present web site, whether visual or audio, including the underlying technology. They remain the sole and exclusive property of FAZO.
Information, logos, designs, marks, models, slogans, graphic charts, and in general, ads and their content (products sold) etc. accessible via this website are protected as well by intellectual and industrial property.
Unless expressly authorized by FAZO, no one is authorized to modify, reproduce, rent, loan, sell, distribute or create products or original and derived works based in whole or in part on the elements on this website.
If you have a website in a personal capacity and would like to place, for personal use, on your site a direct link to the homepage of this website, thank you for asking us beforehand. In all cases, any link must be removed upon request by us.

14. Disputes
The present contract is subject to Belgian law.
In case of dispute or difficulties in the application of this contract, the buyer has the option, before any legal action, to seek an amicable solution with the help of a professional association in the sector, a consumer association or any other counsel of his choice.
Claims or disputes will always be received with careful consideration, good faith is always presumed in those who take the effort to explain his situation.
Failing an amicable solution, the Commercial Court of Brussels has exclusive jurisdiction, regardless of the place of delivery and payment method accepted.
